DXone Ltd. is the owner of this website, the DXone exchange, and DXone mobile application.

DXone Ltd. is a private limited company, registered with the Cyprus Registrar of Companies under number HE407003, having its registered office at Victory House, 205 Archbishop Makarios Avenue, Limassol, 3030 Cyprus.

Pursuant to Cyprus Security and Exchange Commission (CySEC) Circular C.268 "Any activity relating to virtual currencies is not currently regulated by CySEC, unless a virtual currency meets the criteria and falls under the existing regulatory framework as per CySEC’s announcement dated 15 November 2017” (emphasis added).

DXone Ltd. does not facilitate the buying, selling, or trading of any virtual currency, cryptocurrencies, tokens, or digital coin which falls under the existing regulatory framework. DXone Ltd. is commented to strictest compliance with applicable regulations established by the applicable regulatory body and nations in which it operates.

Terms of Use

These Terms of Use ("Terms") are a contract between you and DXone Ltd. (“DXone”) with its principal offices at Victory House, 205 Archbishop Makarios Avenue, Limassol, 3030 Cyprus and applies to your use of DXone.com, the DXone platform, DXone mobile applications and any products, services, or content found on the proceeding.

Use of Dxone amounts to acceptance of these policies and all users must read, agree with, and accept all of the terms. This is a legally binding contract, and users are advised to carefully read these Terms of Use, all related notices and to consult a specialist including but not limited to a financial consultant, tax advisor, or lawyer before continuing use of DXone. By registering, accessing or using DXone, you have agreed to the terms and conditions as laid out in these Terms of Use.

In addition to these Terms of Use, users of DXone is additionally subject to the following; Acceptable Use policy, Cookie policy, Privacy policy, KYC/AML policy, Law Enforcement Requests policy, and Risk Warning. These policies, as well as any future policies of which due notice shall be given, comprise an integral part of these Terms of Use.

You agree that disputes between you and DXone will be resolved as detailed in this Terms of Use. You waive all rights to participate in a class action lawsuit or class-wide arbitration unless such a waiver is specifically prohibited in your jurisdiction.

If you the user do not agree with any condition of these Terms of Use or any integral part of these terms, you should discontinue your use of DXone and deactivate your account immediately.

DXone attempts but cannot guarantee the accuracy, suitability, reliability, completeness, performance or fitness for purpose of the content found on the website or made available through the application, and will not accept liability for any loss or damage that may arise directly or indirectly from the content or your use of it on this site or in any other way including live trading on other platforms or other commercial reliance on information found on this site. DXone does not provide investment advice and no material found on this site or in relation to any services provided by DXone should be considered as investment advice.

To register for an account on DXone, go to DXone registration. You will be asked to provide certain personal information and a password and to verify your account via an email address as well as additional identification information including material in accordance with the European Union’s AMLD5 directive and its requirements. Registering for an account with DXone requires acceptance of these Terms of Use which will be indicated by checking the appropriate box during the registration process.

DXone reserves all rights to refuse to open an account, to limit live trading, to deny access to the website or application to any user for any reason including but not limited to restrictions based on geography.

If for any reason you do not agree to these Terms of Use or any of the integrated policies, do not register for a DXone account.

Definitions

“Account” means a personal or business account created on DXone. This is done by completing the account registration material available on the DXone site or via the DXone mobile application.

“Account holder” means the individual or entity whose name has been associated with the account during the DXone account registration process and who is authorized to perform transactions on behalf of an account.

“AML Documentation” means the documentation required to be provided by the Account holder as set out in our Anti-Money Laundering Policy.

“DXone”, “company” “we” and “us” are references to DXone Ltd. with its principal offices at Victory House, 205 Archbishop Makarios Avenue, Limassol, 3030 Cyprus.

“Cryptocurrency” means any digital asset found on DXone including Bitcoin, Etherium, or any other coin, token, or currency which is not fiat.

“User”, “Your” and “You” means a user of the DXone website, platform, or application including both anyone who is or is not registered for a DXone account.

“Fiat Currency” means any national government issued currency (such as Euro). This definition categorically excludes any and all cryptocurrency including any “stable coins” whose intention is to be linked to an existing fiat currency.

“Personal Information” has the meaning set out in the Privacy policy.

“Platform”, “service”, “application” and “site” means the website, application, and/or live trading platform which can be found at DXone.com, the mobile application, and any related subdomains.

“Sanctions List” means the one or more official sanction lists maintained by governments and intergovernmental organizations. They may include the “Specially Designated Nationals and Blocked Persons” (“SDN”) List and the Non-SDN lists, including, but not limited to, the “Sectoral Sanctions Identifications List”, published by OFAC; the Section 311 Special Measures for Jurisdictions, Financial Institutions, or International Transactions of Primary Money Laundering Concern published by FinCEN; and, any other foreign terrorist organization or other sanctioned, restricted, or debarred party list published by the FIA, or under Economic Sanctions, AML, or CTF Laws of or by the Cyprus, United States, the European Union, or the United Nations.

“Sanctioned Person” refers to any person or digital token wallet or address that is: (i) specifically listed in any Sanctions List; (ii) directly or indirectly owned 50 percent or more by any person or group of persons in the aggregate, or a digital tokens wallet associated with such person or persons, referred to in any Sanctions List, or government or government official of any prohibited jurisdiction; or (iii) that is subject to any government approval or otherwise sanctioned, restricted, or penalized under applicable laws.

“Third-Party Applications” means any website, phone application, or other similar service which the user may use in conjunction with their account for any reason or purpose.

“Terms of Use” means these Terms of Use which may be changed, amended, or updated at anytime as well as Acceptable Use policy, Cookie policy, Privacy policy, KYC/AML policy, Law Enforcement Requests policy; Risk Warning; or any other policy adopted by DXone Ltd.

Eligibility

Users affirm that they are at least 18 years old, of sound mind, and have the full legal capacity to enter into these Terms of Use. If you are using this site in a personal capacity, then you warrant that you are acting on your own behalf. If you are using this site as a legal entity, you warrant that this legal entity is duly incorporated and in good standing under the applicable laws of the jurisdiction of its incorporation and the representative of such registered legal entity is duly authorized by the former to act on its behalf. You further affirm, either in their personal capacity or on behalf of a legal entity has the authority to enter into these Terms of Use and that this will not violate any other agreements to which they may be a party and are not under any asset related freezing order or any other interdiction or restriction of any kind under applicable law entering into transactions or owning and disposing of assets. Accounts can only be used by the person or entity under whose name they are registered. DXone may suspend, freeze or cancel accounts that are used by persons other than the persons whose names they are registered under and does not take legal responsibility for these accounts.

The user further represents that they have not been previously suspended from any service provided by DXone. Failure to meet these eligibility requirements will result in the users account being frozen or canceled and the possibility of legal claims being filed against the user.

Prohibition of Use

In addition to abiding by all terms and requirements of the Acceptable Use policy, you acknowledge and declare that you are not on any Sanctions List. As outlined by DXone, the service may be limited to users in certain jurisdictions.

All use of the DXone site, mobile application, and services must be in compliance with the requirements of applicable laws, regulations and can not be in violation of public interests, public ethics or other’s legitimate interests; and will not constitute evasion of payable taxes or fees and will not violate these Terms of Use or relevant rules. If the user violates the foregoing promises and thereby causes any legal consequence, they shall independently undertake all of the legal liabilities in their own name and indemnify the DXone from all actions, claims, or costs arising from such violation. The user will use the site in accordance with the Terms of Use, without taking acts of unfair competition nor attempting to intervene with the normal operation of DXone. Examples of such malicious acts include, but are not limited to; using a device, software or subroutine to interfere with the site; overloading network equipment with unreasonable data loading requests; executing malicious sales or purchases on the market.

Third Party Applications

If the user grants permission to a third party application to connect to their DXone account, you acknowledge that this does not relieve you of any responsibilities under these Terms of Use. Additionally, the user acknowledges and agrees to not hold DXone responsible for and will indemnify DXone from any liability stemming from any third party application.

Client Funds/Asset Safeguarding

DXone understands the importance of safeguarding the funds from our users and has industry standard protections for this purpose. DXone asks that you help in this effort by taking safety precautions to protect your own account and personal information. To this end, the user is the only person or entity who is responsible for the safekeeping of their account and password and they are responsible for all activities under their log-in email, account and password.

The user agrees that they will notify the DXone immediately if they are aware of any unauthorized use of their account and password by any person or any other violations of the security rules and that DXone will not be responsible for any loss for any reason associated with account security including but not limited to hacking or other unauthorized account access.

DXone has implemented commercially reasonable technical and organisational measures to secure user accounts and information from unauthorised use. However, DXone does not in any way guarantee that unauthorised third parties will never be able defeat those measures. Users acknowledge and accept to the extent applicable under law that they provide their personal information at their own risk.

DXone will never ask for any password from its users. If you have been contacted by any party asking for your password, please inform DXone immediately at contact@dxone.com.

Privacy

The user provides DXone with certain personal information when they create and register an account on the site. All information regarding the use of this information can be found at the Privacy policy and additionally the Cookie policy, the terms of which are hereby incorporated into these Terms of Use.

You agree that all information they provide to DXone is accurate and authentic. Further, that the information is truthful, complete and updated in a timely manner should any changes occur including the contact email address. DXone may contact the user asking for additional information related to the information provided for their account or may terminate the user account at any time for any reason.

Accounts, Transactions and Fees

All transactions are final and irreversible.

You agree that DXone has the right to unilaterally determine whether the user has violated any part of these Terms of use and take actions to apply relevant rules without receiving the users consent or without DXone giving prior notice. This may include but is not limited to; block and close order requests, limited to canceling or reversing potentially high-risk transactions, or to change the buy/sell limits on a users account, freezing accounts, reporting any incidents to the proper authorities, publishing on any platform and with any medium the alleged violations and actions that have been taken, and deleting any published information.

All fees or other charges are at the sole discretion of DXone and may be changed at any time for any reason without warning.

Funds Availability

In the event DXone needs to retrieve funds from offline storage, there can be a delay of up to 72 hours when fulfilling user requests for funds.

Account Termination

DXone will maintain complete and full custody of all user funds and user data/information should an account be suspended or closed due to a violation of these Terms of Use, issues arising from the KYC/AML process, a criminal investigation, or for any other reason. All related user data may be turned over to the relevant authorities as outlined in our law enforcement policies.

Announcements

All official communications, including changes to these Terms of Use will be posted on the DXone website. Other forms of communication with our users may be employed, including but not limited to direct contact via email or via social media. However, DXone will not be held liable or responsible if users incur losses including personal or financial losses arising from ignorance of our communications or negligence in following them.

The user agrees that any notice, agreement, disclosure or other communications will satisfy any legal requirements, including that such communications be in writing.

Restricted countries

Currently, we are not accepting users from the following countries. USA, Albania, Belarus, Bosnia, Burma, Central African Republic, Democratic Republic of Congo, Democratic People's Republic of Korea, Cote D'Ivoire, the Crimea region of Ukraine, Croatia, Cuba, Herzegovina, Iran, Iraq, Kosovo, Lebanon, Liberia, Libya, Macedonia, Moldova, Serbia, Somalia, Sudan, South Sudan, Syria, Venezuela, Yemen, or Zimbabwe.”

Compliance with Local Laws

You have the responsibility to understand and follow all relevant legal and regulatory frameworks applicable to in your local jurisdiction(s) and represent and warrant that your use of DXone and all related services is conducted in a way which is permissible in your local jurisdiction(s). Users represent that they remain current to the changing legal and regulatory landscape for the regulation and categorisation of products, such as cryptocurrencies, found on DXone including products which some jurisdictions where the user may be subject to the relevant laws may categorize these as securities or other regulated financial instruments. This also includes all aspects of any scheme of taxation applicable to you and your use of the DXone site or mobile application, including any duty in respect of withholding, collection, reporting and remittance to appropriate tax authorities.

You represent that you only engage in the use of this website in ways which are permitted in your jurisdiction.

Intellectual Property

DXone and any affiliated companies are the sole owners of the DXone site and mobile application and any services, which includes any software, domains, and content, graphics, logos, icons and service names. These are protected by; Cyprus and international copyright and other intellectual property laws, including those applicable to unregistered trademarks or trade dress without limitation. Users are not permitted to sell, export, license, modify, copy, translate, extract the source code, make derivative versions, distribute or transmit the DXone site or mobile application in whole or part or any material provided through the site without prior express written consent.

All other trademarks not owned by DXone that appear in connection with the site are the property of their respective owners, who may or may not be affiliated with, connected to DXone.

Source of Funds

Users of DXone and all related websites and services declare that the source of their funds is a legitimate economic activity and that all funds used in relation to this site are not derived from illegal activities. DXone may request proof of the source of a user's funds. Failure to provide adequate proof may result in a users account being terminated as per this Terms of Use.

Force Majeure

DXone will not be liable for any loss or delay or failure in performance of any part of these Terms of Use or any related website or service for any cause beyond our reasonable control including, without limitation, acts of God, acts or omissions of civil or military authority, government restrictions or regulations, embargoes, epidemics, wars, terrorist acts, riots, insurrections, strikes, industrial or labour disputes of any kind, fires, explosions, earthquakes, floods, accidents, compliance with any statutory, regulatory or legal obligation, act of sabotage, major environmental disturbances, unusually severe weather conditions, exchange or market disruption, suspension of live trading, periods of abnormal or unusual market activity, unanticipated dealing volumes, inability to communicate with market makers, telecommunication failure, energy failure, internet outages, cyber-attacks, viruses or hacking, or any other cause outside our reasonable control. DXone will not be liable for any failure or delay of service resulting from regular network maintenance or external factors such as power failure, natural disaster, pandemics, service provider-side problems or governmental acts.

Indemnification

The user agrees to hold harmless, defend and indemnify DXone, affiliates, parent companies, and subsidiaries, and each respective officers, directors, agents, employees, representatives, and permitted assignees against any and all any losses, damages, costs, fines, liabilities and expenses including reasonable attorney’s fees that have been reasonably incurred in connection with any claims or damages arising out of or related to a breach of these Terms of Use or any other applicable law, regulation, or rights of any third party and any subsequent enforcement including but not limited to actions undertaken by DXone or any other individual or legal entity on their behalf.

No Warranty

DXone provides all services “as is” and without any warranty or condition, whether express, implied or statutory. DXone assumes no liability or responsibility for any errors or omissions; any failures, delays or interruptions, or in the delivery of any order; any losses or damages arising from the use of this site or any services. DXone reserves the right to deliver the site and services and to process orders in its sole and absolute discretion. In no event shall DXone, its shareholders, directors, officers, employees or agents be liable (jointly or severally) to the user for loss of use or any special, incidental, indirect or consequential damages arising out of or in connection with the site or services, the publication of any listings, the placement of any order, the delivery of any goods, the failure in whole or in part to deliver any goods or these Terms of use, on any theory of liability, and whether or not advised of the possibility of damage. DXone does not seek to exclude liability for death or personal injury caused by our negligence, or fraud or fraudulent misrepresentation by DXone. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law. DXone specifically excludes liability for any loss, harm, distress or damage suffered by users as a result of inaccurate information appearing on the site or services, placed either by DXone or any third party.

Limitation of Liability

You acknowledge and agree that DXone shall not be liable for any losses, financial or otherwise, caused by any of the following events, including but not limited to: changes to user accounts resulting from live trading, profits, goodwill, usage or data or any other intangible losses; use or failure to use of the DXone site or any service; unauthorized use of the users account or unauthorized alteration of your data by third parties; any misunderstanding of the services provided on this site; and any other losses related to the DXone site or any service. DXone and any affiliates shall not be liable for damages of whatever kind or nature, including indirect, moral consequential, special or exemplary damages, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, including, without limitation, damages to the user’s hardware, device, device’s software or data; losses or damages arising out of or relating to any inaccuracy, defect or omission of crypto assets price data; system errors; deletion or loss of files; errors or delays in transmission of instructions, data or other information; any interruption in any such data; any failure of either the DXone server or the internet; inaccessibility and/or failure to access the site or online trading platform; or any damages sustained to your computer equipment, damages for loss of income or earnings that the user may suffer arising out of or relating to the use, inability to use or non-use of the services and any loss suffered or incurred by the user or any event beyond the DXone’s reasonable control. For the avoidance of doubt, this limitation of liability section shall survive the termination of these Terms of Use and shall apply, with full force and effect, in perpetuity for the benefit of the parties, and any other entity that is or becomes the owner of the services, whether such ownership occurs through a sale, merger, other transaction or by the operation of applicable law.

No Waiver

No waiver by any party of any breach of these Terms of Use or any delay or omission by any party in enforcing the terms of these Terms of Use shall prejudice their rights or operate as a waiver of any subsequent or continuing breach.

Resolution of Disputes

Any claim by the user arising out of or related to DXone must be filed within one year after such claim arose or will be permanently barred.

Any offer of resolution made to the user will only become binding on DXone if accepted by the user. An offer of resolution will not constitute any admission by DXone of any wrongdoing or liability regarding the subject matter of the complaint. DXone reserves the right to resolve disputes at its own time and disclosure. Such disputes may refer to infringement of others’ rights, violation of laws and regulations, abnormal trades and others not explicitly mentioned in these Terms of Use. The user agrees to bear the costs arising from the process of any dispute resolutions.

Users who wish to file a complaint must do so by submitting the relevant complaint form to the email address legal@dxone.com, accompanied by any relevant information. No Assignment

The user is not permitted to assign, transfer, charge, sub-contract or deal in any other manner with all or any of their rights or obligations under these Terms of Use without prior express written consent from DXone.

Severability

If any provision of these Terms of Use is or becomes illegal or invalid, that provision will be deemed deleted from these Terms of Use and the remaining provisions shall continue in force.

Entire Agreement

These Terms of Use set forth the entire understanding and agreement between the user and DXone with respect to the subject matter hereof.

Governing Law and Jurisdiction

This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of Cyprus.

Informal Negotiations

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms of Use brought by DXone users, the users agree to first attempt to negotiate any dispute informally for at least 1 month days before initiating legal action. Such informal negotiations commence upon written notice provided to the contact found in these Terms of Use.

DXone reserves the right to revise these Terms of Use at any time and for any reason. The most current and recent version can be found at this page and with the date at the top of this page.     • Social media data includes social media handles and other social media profile information that you make available to us or to the public.

  • Selected third parties we use to help deliver our products and/or services to you including: business partners, brokers, vendors, insurers, fraud prevention services, payment service providers for the performance of any contract we enter into with them or you; analytics and search engine providers that assist us in the improvement and optimization of our site;

credit reference agencies and/or banking and financial institutions and/or auditors for, among others, the purpose of assessing your credit score (where this is a condition of us entering into a contract with you).

  • For the purposes of complying with local and international regulations against money-laundering, fraud and the general prevention of crime and illegal activities, we maintain communications with law enforcement agencies and regulatory bodies of those jurisdictions relevant to your citizenship and our legal requirements for compliance with those regulations including for tax reasons. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

5. Where we store your personal data

All information you provide to us is stored on secure servers. Where we may have given you (or where you have chosen) a password which enables you to access certain parts of our site and/or use any other of our services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to us; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access. 6. Duration your personal information will be kept

We will keep your personal information while you have an account with us or while we are providing services and/or products to you or while we are in a contractual relationship with you. Thereafter, we will keep your personal information for as long as is necessary:

  • to respond to any questions, complaints or claims made by you or on your behalf;
  • to show that we treated you fairly;
  • to keep records required by law, regulations and regulatory authorities.

We will not retain your personal information for longer than necessary for the purposes set out in this policy. Different retention periods apply for different types of personal information. When it is no longer necessary to retain your personal information, we will delete or anonymize it.

By law we are required to keep certain data for minimum periods, namely:

  • we must retain Transaction Data for a minimum of six years after the date of the transaction;
  • we must retain certain Account Information, for a minimum of six years after your agreement with us has ended.

The majority of personal data we hold will be deleted 10 years after the termination of any agreement you have with us unless it is needed for other necessary or legitimate purposes. In some circumstances you can ask us to delete your data: see request erasure below for further information. In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

7. Transferring your personal information outside the EEA

All information you provide to us will be transferred and stored in a jurisdiction located in the European Economic Area (EEA). However, we may transfer some or all of your data to countries outside of the EEA which may not offer the same level of protection as the General Data Protection Regulations with respect to the processing of your personal data.

In processing a request, the identity of the data subject needs to be verified before information will be released. No personal data will be disclosed to a third party without the written consent of the data subject.

We reserve the right to refuse repeated/vexatious requests.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights) unless they are clearly repetitive or vexatious.

9. Keeping your personal information secure

We have appropriate technical and organizational security measures to prevent personal information from being accidentally lost, used or accessed unlawfully. We limit access to your personal information to those who have a genuine business need to access it. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality.

We also have procedures in place to deal with any suspected data security breaches. We will notify you and the relevant supervisory authority of a suspected data security breach when we are legally required to do so.

Law Enforcement Requests policy

Law enforcement agencies regularly contact DXone Ltd. (DXone) regarding information. These law enforcement agencies may include agencies investigating criminal activity, administrative agencies regarding regulatory violations and courts. The purpose of this notice is to provide both our website users and those members of the law enforcement community with information about these requests. Users looking to access their own information should consult our privacy policy.

DXone’s policy regarding such requests is that a valid legal production process (for example, a subpoena, court order or search warrant) must at all times be followed. This may be different in each jurisdiction as well as for each type of request. Each request is reviewed to ensure that the legal process is being followed and must include information regarding the scope of the request. The remedy being requested must match the process used in each case and may not be overly vague or broad. Account Termination

Breach of this policy and appropriate action in response will be determined at our sole discretion. The failure to comply with any part of this Acceptable Use policy will be considered a breach of the Terms of Use, which were agreed to by using DXone.

The breach of these terms may result in any or all of the following actions

  • Written warning
  • Termination of the users account either temporary or permanently
  • Legal proceedings against the users for any reason including indemnity for any costs associated with these actions
  • Disclosure of any and all information to law enforcement authorities in your jurisdiction or any other jurisdiction
  • Other further actions at the discretion of DXone

By downloading or using the DXone mobile application you agree to the following Terms and Conditions in addition to the DXone Terms of Use.  You should make sure to read all these policies carefully before using the application.

DXone reserves the right to make changes to the mobile application at any time and for any reason. It is the users responsibility to keep their phone and access to the DXone mobile application secure. DXone therefore recommends that users do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of their device. These steps could make your phone vulnerable to malware/viruses/malicious programs, compromise the phone’s security features and could limit the functionality of the DXone application. The DXone app does use third party services that declare their own Terms and Conditions.

Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by the users mobile network provider. If you’re using the DXone mobile application outside of Wi-Fi, the user should remember that the terms of the agreement with their mobile network provider will still apply. As a result, the user may be charged by their mobile provider for the cost of data for the duration of the connection while accessing the DXone mobile application, or other third party charges. In using the DXone mobile application, the user accepts responsibility for any such charges including roaming data charges.

DXone accepts no liability for any loss, direct or indirect, the user experiences as a result of relying wholly on this functionality of the app.

The DXone mobile application is currently available on Android and iOS. The system requirements may change without notice, and the user may need to download updates if they wish to keep using the app. DXone does not guarantee to update the mobile application to be relevant to the Android or iOS version installed on the users device. DXone may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination. Unless stated explicitly, upon any termination, (a) the rights and licenses granted to the user in these terms will end; (b) the user must stop using the app, and (if needed) delete it from your device.

Changes to Mobile Application Terms and Conditions

Anti-Money Laundering (AML) and Know Your Customer (KYC) Policy

DXOne Ltd (“DXone”) has an Anti-Money Laundering, Counter-Terrorist Financing and Know Your Customer Policy (“AML/KYC policy”) to maintain legal compliance with our obligation to identify, prevent and mitigate risks of activity not permitted by the law.

This AML/KYC policy is an integral part of the DXone Terms of Use (link) and should be read as part of the Law Enforcement Requests policy (link) and in accordance to our Privacy policy (link). The legal basis for this AML/KYC policy includes but is not limited to the European Union’s 5th Anti-Money Laundering Directive ((EU) 2018/843) and Cyprus’s Prevention and Suppression of Money Laundering Activities Law of 2007 (L188(I)/2007).

Risk Assessment

Following guidance from the Financial Action Task Force (FATF) an independent inter-governmental body that develops and promotes policies to protect the global financial system against money laundering, terrorist financing and the financing of proliferation of weapons of mass destruction and Cyprus Securities and Exchange Commission (CySEC), DXone takes a risk-based approach to assess and mitigate risk.

Compliance Officer

DXone has appointed a compliance officer who is the point person to oversee all AML/KYC activity. This person is knowledgeable about financial crime regulations and laws, is the liaison for law enforcement officers, has developed our internal controls and tools and has conducted ongoing training for DXone staff. Transactions Monitoring

Transaction monitoring helps DXone to follow transactions such as deposits, withdrawls, and trades 24/7 and in real time. The monitoring helps to undercover patterns or outlier activity and to monitor the level of risk that is associated with each user and their transactions. For example, transaction monitoring can flag a large withdrawal from the otherside of the world as suspicious, providing key information to aid law enforcement and the client. Transaction monitoring can reduce fraud and all money laundering. Transaction monitoring can also include daily blacklist or politically exposed persons (PEP) monitoring. DXone along with its partners complete a range of data analysis on transactions undertaken on the platform and their patterns. These steps include recording data, filtering, record-keeping, investigation management, and reporting. When needed, DXone may take additional steps, including but not limited to, request additional verification for users transactions, to place users on watch lists, or to file any reports such as a suspicious activity report (SAR) with the appropriate law enforcement authorities.

KYC verification

Know-Your-Customer (KYC) is the standard protocol against both in traditional financial services as well as the cryptocurrency industry. The DXone verification procedures are industry standard. In accordance with our partners, DXone will use documents and information provided by users to confirm the identity of all users on the platform. Users whose identity can not be confirmed may not be granted access to DXone and all users who are identified as dangerous or suspicious will be flagged. DXone reserves the right to require additional information on an ongoing basis to reverify users, particularly should users or their transactions suggest a higher than average risk. DXone reserves the right to refuse to provide its services to users for any reason and without explanation.

In Cyprus, this includes the Central Bank of Cyprus’ Directive (Fifth Edition) issued in accordance with Article 59(4) of the Prevention and Suppression of Money Laundering Activities Laws of 2007 to 2018 (“Law”). This Cyprus legislation and EU directives including the Fifth Money Laundering Directive (5AMLD) implemented on January 10th, 2020 are intended for the prevention of using the financial system including exchanges such as DXone money laundering and terrorist Financing.

Article 62(1) of the Law requires that the identification of the customer and the beneficial owner is performed prior to the establishment of the business relationship or the execution of a transaction. It is for this reason we provide the KYC at the start of your on-boarding. Article 61(1) of the Law requires that the customer identification procedures and due diligence measures, include the following: (i) the identification and the verification of the customer's identity on the basis of documents, data or information issued or obtained by a reliable and independent Source. To do so, we work with our KYC partners to verify that the person registering the account matches with the name and address of existing real persons who have not been convicted of financial crimes.

DXone does not currently accept fiat funds and thus is not subject to any specific requirement to trace the origins of those funds or any regulation which targets cryptocurrency platforms. Should DXone offer this feature in the future, these policies will change in accord with international and national regulations.

Use of Dxone amounts to acceptance of these policies and all users must read, agree with, and accept all of the terms. This is a legally binding contract, and users are advised to carefully read these Terms of Use, all related notices and to consult a specialist including but not limited to a financial consultant, tax advisor, or lawyer before continuing use of DXone. By registering, accessing or using DXone, you have agreed to the terms and conditions as laid out in these Terms of Use.

In addition to these Terms of Use, users of DXone is additionally subject to the following; Acceptable Use policy, Cookie policy, Privacy policy, KYC/AML policy, Law Enforcement Requests policy, and Risk Warning. These policies, as well as any future policies of which due notice shall be given, comprise an integral part of these Terms of Use.

You agree that disputes between you and DXone will be resolved as detailed in this Terms of Use. You waive all rights to participate in a class action lawsuit or class-wide arbitration unless such a waiver is specifically prohibited in your jurisdiction.

DXone attempts but cannot guarantee the accuracy, suitability, reliability, completeness, performance or fitness for purpose of the content found on the website or made available through the application, and will not accept liability for any loss or damage that may arise directly or indirectly from the content or your use of it on this site or in any other way including live trading on other platforms or other commercial reliance on information found on this site. To register for an account on DXone, go to DXone registration. Definitions

“Account” means a personal or business account created on DXone. This is done by completing the account registration material available on the DXone site or via the DXone mobile application.

“Account holder” means the individual or entity whose name has been associated with the account during the DXone account registration process and who is authorized to perform transactions on behalf of an account.

“AML Documentation” means the documentation required to be provided by the Account holder as set out in our Anti-Money Laundering Policy.

“DXone”, “company” “we” and “us” are references to DXone Ltd. with its principal offices at Victory House, 205 Archbishop Makarios Avenue, Limassol, 3030 Cyprus.

“Cryptocurrency” means any digital asset found on DXone including Bitcoin, Etherium, or any other coin, token, or currency which is not fiat.

“User”, “Your” and “You” means a user of the DXone website, platform, or application including both anyone who is or is not registered for a DXone account.

“Fiat Currency” means any national government issued currency (such as Euro). This definition categorically excludes any and all cryptocurrency including any “stable coins” whose intention is to be linked to an existing fiat currency.

“Personal Information” has the meaning set out in the Privacy policy.

“Platform”, “service”, “application” and “site” means the website, application, and/or live trading platform which can be found at DXone.com, the mobile application, and any related subdomains.

“Sanctions List” means the one or more official sanction lists maintained by governments and intergovernmental organizations. They may include the “Specially Designated Nationals and Blocked Persons” (“SDN”) List and the Non-SDN lists, including, but not limited to, the “Sectoral Sanctions Identifications List”, published by OFAC; the Section 311 Special Measures for Jurisdictions, Financial Institutions, or International Transactions of Primary Money Laundering Concern published by FinCEN; and, any other foreign terrorist organization or other sanctioned, restricted, or debarred party list published by the FIA, or under Economic Sanctions, AML, or CTF Laws of or by the Cyprus, United States, the European Union, or the United Nations.

“Sanctioned Person” refers to any person or digital token wallet or address that is: (i) specifically listed in any Sanctions List; (ii) directly or indirectly owned 50 percent or more by any person or group of persons in the aggregate, or a digital tokens wallet associated with such person or persons, referred to in any Sanctions List, or government or government official of any prohibited jurisdiction; or (iii) that is subject to any government approval or otherwise sanctioned, restricted, or penalized under applicable laws.

“Third-Party Applications” means any website, phone application, or other similar service which the user may use in conjunction with their account for any reason or purpose.

“Terms of Use” means these Terms of Use which may be changed, amended, or updated at anytime as well as Acceptable Use policy, Cookie policy, Privacy policy, KYC/AML policy, Law Enforcement Requests policy; Risk Warning; or any other policy adopted by DXone Ltd.

Eligibility

Users affirm that they are at least 18 years old, of sound mind, and have the full legal capacity to enter into these Terms of Use. If you are using this site in a personal capacity, then you warrant that you are acting on your own behalf. If you are using this site as a legal entity, you warrant that this legal entity is duly incorporated and in good standing under the applicable laws of the jurisdiction of its incorporation and the representative of such registered legal entity is duly authorized by the former to act on its behalf. You further affirm, either in their personal capacity or on behalf of a legal entity has the authority to enter into these Terms of Use and that this will not violate any other agreements to which they may be a party and are not under any asset related freezing order or any other interdiction or restriction of any kind under applicable law entering into transactions or owning and disposing of assets. Accounts can only be used by the person or entity under whose name they are registered. DXone may suspend, freeze or cancel accounts that are used by persons other than the persons whose names they are registered under and does not take legal responsibility for these accounts.

The user further represents that they have not been previously suspended from any service provided by DXone.  Failure to meet these eligibility requirements will result in the users account being frozen or canceled and the possibility of legal claims being filed against the user.

Prohibition of Use

In addition to abiding by all terms and requirements of the Acceptable Use policy, you acknowledge and declare that you are not on any Sanctions List. As outlined by DXone, the service may be limited to users in certain jurisdictions.

All use of the DXone site, mobile application, and services must be in compliance with the requirements of applicable laws, regulations and can not be in violation of public interests, public ethics or other’s legitimate interests; and will not constitute evasion of payable taxes or fees and will not violate these Terms of Use or relevant rules. If the user violates the foregoing promises and thereby causes any legal consequence, they shall independently undertake all of the legal liabilities in their own name and indemnify the DXone from all actions, claims, or costs arising from such violation. The user will use the site in accordance with the Terms of Use, without taking acts of unfair competition nor attempting to intervene with the normal operation of DXone. Examples of such malicious acts include, but are not limited to; using a device, software or subroutine to interfere with the site; overloading network equipment with unreasonable data loading requests; executing malicious sales or purchases on the market.

Third Party Applications

If the user grants permission to a third party application to connect to their DXone account, you acknowledge that this does not relieve you of any responsibilities under these Terms of Use. Additionally, the user acknowledges and agrees to not hold DXone responsible for and will indemnify DXone from any liability stemming from any third party application. 

Security

DXone understands the importance of safeguarding the funds from our users and has industry standard protections for this purpose. DXone asks that you help in this effort by taking safety precautions to protect your own account and personal information. To this end, the user is the only person or entity who is responsible for the safekeeping of their account and password and they are responsible for all activities under their log-in email, account and password.

The user agrees that they will notify the DXone immediately if they are aware of any unauthorized use of their account and password by any person or any other violations of the security rules and that DXone will not be responsible for any loss for any reason associated with account security including but not limited to hacking or other unauthorized account access.

DXone has implemented commercially reasonable technical and organisational measures to secure user accounts and information from unauthorised use. However, DXone does not in any way guarantee that unauthorised third parties will never be able defeat those measures. Users acknowledge and accept to the extent applicable under law that they provide their personal information at their own risk.

DXone will never ask for any password from its users. If you have been contacted by any party asking for your password, please inform DXone immediately at contact@dxone.com.

Privacy

The user provides DXone with certain personal information when they create and register an account on the site. All information regarding the use of this information can be found at the Privacy>Privacy policy and additionally the Cookie policy, the terms of which are hereby incorporated into these Terms of Use.  

You agree that all information they provide to DXone is accurate and authentic. Further, that the information is truthful, complete and updated in a timely manner should any changes occur including the contact email address. DXone may contact the user asking for additional information related to the information provided for their account or may terminate the user account at any time for any reason.

Accounts, Transactions and Fees

Users have no right to retroactively alter their trades or transactions and should consider all to be final and irreversible.

Notwithstanding the above, you agree that DXone has the right to unilaterally take action on a users account which may impact their current or future transactions. This may include but is not limited to; block and close order requests, limited to canceling or reversing potentially high-risk transactions, or to change the buy/sell limits on a users account, freezing accounts, reporting any incidents to the proper authorities, publishing on any platform and with any medium the alleged violations and actions that have been taken, and deleting any published information.

You agree that DXone has the sole right to determine whether the user has violated any part of these Terms of use and take actions to apply relevant rules without receiving the users consent or without DXone giving prior notice.

All fees or other charges are at the sole discretion of DXone and may be changed at any time for any reason without warning.

Funds Availability

In the event DXone needs to retrieve funds from offline storage, there can be a delay of up to 72 hours when fulfilling user requests for funds.

Account Termination

DXone will maintain complete and full custody of all user funds and user data/information should an account be suspended or closed due to a violation of these Terms of Use, issues arising from the KYC/AML process, a criminal investigation, or for any other reason. All related user data may be turned over to the relevant authorities as outlined in our Law Enforcement Requests policy.

Announcements

All official communications, including changes to these Terms of Use will be posted on the DXone website. Other forms of communication with our users may be employed, including but not limited to direct contact via email or via social media. However, DXone will not be held liable or responsible if users incur losses including personal or financial losses arising from ignorance of our communications or negligence in following them.

The user agrees that any notice, agreement, disclosure or other communications will satisfy any legal requirements, including that such communications be in writing.

Compliance with Local Laws

You have the responsibility to understand and follow all relevant legal and regulatory frameworks applicable to in your local jurisdiction(s) and represent and warrant that your use of DXone and all related services is conducted in a way which is permissible in your local jurisdiction(s). Users represent that they remain current to the changing legal and regulatory landscape for the regulation and categorisation of products, such as cryptocurrencies, found on DXone including products which some jurisdictions where the user may be subject to the relevant laws may categorize these as securities or other regulated financial instruments. This also includes all aspects of any scheme of taxation applicable to you and your use of the DXone site or mobile application, including any duty in respect of withholding, collection, reporting and remittance to appropriate tax authorities.

You represent that you only engage in the use of this website in ways which are permitted in your jurisdiction.

Intellectual Property

DXone and any affiliated companies are the sole owners of the DXone site and mobile application and any services, which includes any software, domains, and content, graphics, logos, icons and service names. These are protected by; Cyprus and international copyright and other intellectual property laws, including those applicable to unregistered trademarks or trade dress without limitation. Users are not permitted to sell, export, license, modify, copy, translate,  extract the source code, make derivative versions, distribute or transmit the DXone site or mobile application in whole or part or any material provided through the site without prior express written consent.

All other trademarks not owned by DXone that appear in connection with the site are the property of their respective owners, who may or may not be affiliated with, connected to DXone.

Source of Funds

Users of DXone and all related websites and services declare that the source of their funds is a legitimate economic activity and that all funds used in relation to this site are not derived from illegal activities. DXone may request proof of the source of a user's funds. Failure to provide adequate proof may result in a users account being terminated as per this Terms of Use.

Force Majeure

DXone will not be liable for any loss or delay or failure in performance of any part of these Terms of Use or any related website or service for any cause beyond our reasonable control including, without limitation, acts of God, acts or omissions of civil or military authority, government restrictions or regulations, embargoes, epidemics, wars, terrorist acts, riots, insurrections, strikes, industrial or labour disputes of any kind, fires, explosions, earthquakes, floods, accidents, compliance with any statutory, regulatory or legal obligation, act of sabotage, major environmental disturbances, unusually severe weather conditions, exchange or market disruption, suspension of live trading, periods of abnormal or unusual market activity, unanticipated dealing volumes, inability to communicate with market makers, telecommunication failure, energy failure, internet outages, cyber-attacks, viruses or hacking, or any other cause outside our reasonable control. DXone will not be liable for any failure or delay of service resulting from regular network maintenance or external factors such as power failure, natural disaster, pandemics, service provider-side problems or governmental acts.

Indemnification

The user agrees to hold harmless, defend and indemnify DXone, affiliates, parent companies, and subsidiaries, and each respective officers, directors, agents, employees, representatives, and permitted assignees against any and all any losses, damages, costs, fines, liabilities and expenses including reasonable attorney’s fees that have been reasonably incurred in connection with any claims or damages arising out of or related to a breach of these Terms of Use or any other applicable law, regulation, or rights of any third party and any subsequent enforcement including but not limited to actions undertaken by DXone or any other individual or legal entity on their behalf.

DXone provides all services “as is” and without any warranty or condition, whether express, implied or statutory. DXone assumes no liability or responsibility for any errors or omissions; any failures, delays or interruptions, or in the delivery of any order; any losses or damages arising from the use of this site or any services. DXone reserves the right to deliver the site and services and to process orders in its sole and absolute discretion. In no event shall DXone, its shareholders, directors, officers, employees or agents be liable (jointly or severally) to the user for loss of use or any special, incidental, indirect or consequential damages arising out of or in connection with the site or services, the publication of any listings, the placement of any order, the delivery of any goods, the failure in whole or in part to deliver any goods or these Terms of use, on any theory of liability, and whether or not advised of the possibility of damage. Limitation of Liability

You acknowledge and agree that DXone shall not be liable for any losses, financial or otherwise, caused by any of the following events, including but not limited to: changes to user accounts resulting from live trading, profits, goodwill, usage or data or any other intangible losses; use or failure to use of the DXone site or any service; unauthorized use of the users account or unauthorized alteration of your data by third parties; any misunderstanding of the services provided on this site; and any other losses related to the DXone site or any service. DXone and any affiliates shall not be liable for damages of whatever kind or nature, including indirect, moral consequential, special or exemplary damages, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, including, without limitation, damages to the user’s hardware, device, device’s software or data; losses or damages arising out of or relating to any inaccuracy, defect or omission of crypto assets price data; system errors; deletion or loss of files; errors or delays in transmission of instructions, data or other information; any interruption in any such data; any failure of either the DXone server or the internet; inaccessibility and/or failure to access the site or online trading platform; or any damages sustained to your computer equipment, damages for loss of income or earnings that the user may suffer arising out of or relating to the use, inability to use or non-use of the services and any loss suffered or incurred by the user or any event beyond the DXone’s reasonable control. For the avoidance of doubt, this limitation of liability section shall survive the termination of these Terms of Use and shall apply, with full force and effect, in perpetuity for the benefit of the parties, and any other entity that is or becomes the owner of the services, whether such ownership occurs through a sale, merger, other transaction or by the operation of applicable law.

No Waiver

No waiver by any party of any breach of these Terms of Use or any delay or omission by any party in enforcing the terms of these Terms of Use shall prejudice their rights or operate as a waiver of any subsequent or continuing breach.

Resolution of Disputes

Any claim by the user arising out of or related to DXone must be filed within one year after such claim arose or will be permanently barred.

Any offer of resolution made to the user will only become binding on DXone if accepted by the user. An offer of resolution will not constitute any admission by DXone of any wrongdoing or liability regarding the subject matter of the complaint. DXone reserves the right to resolve disputes at its own time and disclosure. Such disputes may refer to infringement of others’ rights, violation of laws and regulations, abnormal trades and others not explicitly mentioned in these Terms of Use. The user agrees to bear the costs arising from the process of any dispute resolutions.

No Assignment

The user is not permitted to assign, transfer, charge, sub-contract or deal in any other manner with all or any of their rights or obligations under these Terms of Use without prior express written consent from DXone.

Severability

If any provision of these Terms of Use is or becomes illegal or invalid, that provision will be deemed deleted from these Terms of Use and the remaining provisions shall continue in force.

Entire Agreement

These Terms of Use set forth the entire understanding and agreement between the user and DXone with respect to the subject matter hereof.

Governing Law and Jurisdiction

This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of Cyprus.

Informal Negotiations

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms of Use brought by DXone users, the users agree to first attempt to negotiate any dispute informally for at least 30 calendar days before initiating legal action. 1. Introduction

DXone Ltd., (hereafter “the Company”, “We”, “Us”) takes your privacy seriously. Please read this privacy policy carefully as it contains important information on who we are and how and why we collect, store, use and share your personal information. By providing us with your personal information and using our services, you are accepting and consenting to the practices described in this policy. It also explains your rights in relation to your personal information and how to contact us or the supervisory authority in the event you have a complaint.

We collect, use and process certain personal information about you. When we do so we are subject to the EU General Data Protection Regulation 2016/679 (hereafter “GDPR”) and we are responsible as ‘Controller’ of that personal information for the purposes of the GDPR as well as Cyprus Law (125(I)/2018) providing for the protection of natural persons with regard to the processing of personal data and the free movement of such data.

Complaints procedure: DXone Ltd. has the highest standards to protect your privacy. We will collect and process the following data about you:

  • Information you give us: This is information about you that you give us by filling our client forms/agreements, or by corresponding with us by phone, email, in person or otherwise. It includes information you provide when you choose to use our services and/or become an affiliate to our company, participate in any company event and when you send any information to us under any capacity. This information may include but is not necessarily limited to the stated areas,
    • Identity data such as name, address, date of birth, username or similar identifier, title, gender.
    • Identity verification data such as the images of your government issued ID, passport, national ID card, utility bill or driving license.
    • Contact data including your address, messenger or social media handles, email address and telephone numbers.
    • Financial data such as your financial position, status and history, and payment account details which can include bank, credit card, or other payment details.
    • Transaction data which includes details about payments to and from your accounts with us.
    • Technical data includes details about the devices you use to access our services including internet protocol (IP) address, login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access our website or services.
    • Blockchain data such as the blockchain addresses and public keys.
    • Profile data like your username and password, purchases, posts, interests or other information you provide, preferences, feedback or survey responses.
    • Social media data includes social media handles and other social media profile information that you make available to us or to the public.
    • Usage data includes information about how you use our website, products and services.
    • Marketing and Communications data includes your preferences in receiving marketing from us and our third parties and your communication preferences.
    • Aggregated data includes statistical or demographic data for any purpose. This type of data can be created from personal data but legally is not considered personal data because it does not directly or indirectly reveal your identity. If this type of data is connected to your personal data so you are directly or indirectly identified, this will be handled under this privacy notice.
  • Information we collect/receive from other sources: This is information we receive about you if you use any of the websites we operate or the services we provide and/or from other affiliates and/or professionals.   • To provide information to you with information about other services we offer that are similar to those that you have already used or enquired about or to notify you about changes to our services.

4. Disclosure of your information 

You agree that we have the right to share your information with:

  • Any team member of our company for the purpose of ensuring we maintain a correct record, understanding and response regarding all of your communications, requests, responses and interests with us and only as appropriate to ensuring a helpful, constructive business relationship between you and our company, this may include anyone in our group of companies including subsidiaries or our holding company or any of our agents or partners;
  • Selected third parties we use to help deliver our products and/or services to you including: business partners, brokers, vendors, insurers, fraud prevention services, payment service providers for the performance of any contract we enter into with them or you; analytics and search engine providers that assist us in the improvement and optimization of our site;

credit reference agencies and/or banking and financial institutions and/or auditors for, among others, the purpose of assessing your credit score (where this is a condition of us entering into a contract with you).

  • For the purposes of complying with local and international regulations against money-laundering, fraud and the general prevention of crime and illegal activities, we maintain communications with law enforcement agencies and regulatory bodies of those jurisdictions relevant to your citizenship and our legal requirements for compliance with those regulations including for tax reasons. This may include as well for the pursuit of our own legal claims.

We will disclose your personal information to third parties:

  • In the event that this is necessary for the delivery of our products and/or services to you;
  • If DXone Ltd., or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets;
  • If we are under a duty to disclose or share your personal data to comply with any legal and/or regulatory obligation, or to enforce or apply our terms of use and other agreements, or to protect the rights, property, or safety of DXone Ltd., our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection, anti-money laundering and credit risk reduction;

We only allow the third parties we work with to process your personal information if we are satisfied they take appropriate technical and organizational measures to protect your personal information. We also impose contractual obligations on our selected third parties to ensure they can only use your personal information to provide services to us and to you. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

5. Where we store your personal data

All information you provide to us is stored on secure servers. Where we may have given you (or where you have chosen) a password which enables you to access certain parts of our site and/or use any other of our services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to us; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access. We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

6. Duration your personal information will be kept

We will keep your personal information while you have an account with us or while we are providing services and/or products to you or while we are in a contractual relationship with you. Thereafter, we will keep your personal information for as long as is necessary:

  • to respond to any questions, complaints or claims made by you or on your behalf;
  • to show that we treated you fairly;
  • to keep records required by law, regulations and regulatory authorities.

We will not retain your personal information for longer than necessary for the purposes set out in this policy. Different retention periods apply for different types of personal information. When it is no longer necessary to retain your personal information, we will delete or anonymize it.

By law we are required to keep certain data for minimum periods, namely:

  • we must retain Transaction Data for a minimum of six years after the date of the transaction;
  • we must retain certain Account Information, for a minimum of six years after your agreement with us has ended.

The majority of personal data we hold will be deleted 10 years after the termination of any agreement you have with us unless it is needed for other necessary or legitimate purposes. In some circumstances you can ask us to delete your data: see request erasure below for further information. In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

7. Transferring your personal information outside the EEA

All information you provide to us will be transferred and stored in a jurisdiction located in the European Economic Area (EEA). However, we may transfer some or all of your data to countries outside of the EEA which may not offer the same level of protection as the General Data Protection Regulations with respect to the processing of your personal data.

The General Data Protection Regulations is the legal instrument that deals with the protection of your data (‘GDPR’). It is sometimes necessary for us to share and/or store your personal information outside the EEA, for example:

These transfers are subject to special rules under GDPR, as non-EEA countries do not have the same data protection laws as Cyprus and other Member States of the EEA. We will, however, ensure that those transfers comply with the GDPR and that all of your personal information will be secure. Unless the individual has specifically consented to the transfer, we will only transfer personal data outside the EEA where:

  • we transfer the data to a country or international organization which the EU Commission has decided ensures an adequate level of protection for your personal data;

  • one of the derogations in the GDPR to transfer personal data outside the EEA applies.

Where data is to be transferred to a group company in a country outside of the EEA which may not offer the same level of protection as the GDPR with respect to the processing of your personal data, we will ensure that the group company agrees to binding corporate rules in accordance with Article 47 of the GDPR. We use automated processing for services such as tailoring products and services, fraud detection, and opening accounts.

Consent to processing can be withdrawn at any time, where relevant. He/she must contact the DPO if he/she wishes to do so.

We aim to comply with requests of data subjects as quickly as possible and will ensure that we comply with legislation, unless exceptions apply. In such cases, the reasons for any delay will be explained in writing to the data subject making the request.

In processing a request, the identity of the data subject needs to be verified before information will be released. No personal data will be disclosed to a third party without the written consent of the data subject.

Law enforcement agencies regularly contact DXone Ltd. (DXone) regarding information. These law enforcement agencies may include agencies investigating criminal activity, administrative agencies regarding regulatory violations and courts. The purpose of this notice is to provide both our website users and those members of the law enforcement community with information about these requests. DXone’s policy regarding such requests is that a valid legal production process (for example, a subpoena, court order or search warrant) must at all times be followed. By downloading or using the DXone mobile application you agree to the following Terms and Conditions in addition to the DXone Terms of Use.  You should make sure to read all these policies carefully before using the application.

DXone reserves the right to make changes to the mobile application at any time and for any reason. It is the users responsibility to keep their phone and access to the DXone mobile application secure. DXone therefore recommends that users do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of their device. These steps could make your phone vulnerable to malware/viruses/malicious programs, compromise the phone’s security features and could limit the functionality of the DXone application. The DXone app does use third party services that declare their own Terms and Conditions.

Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by the users mobile network provider. If you’re using the DXone mobile application outside of Wi-Fi, the user should remember that the terms of the agreement with their mobile network provider will still apply. As a result, the user may be charged by their mobile provider for the cost of data for the duration of the connection while accessing the DXone mobile application, or other third party charges. In using the DXone mobile application, the user accepts responsibility for any such charges including roaming data charges.

DXone accepts no liability for any loss, direct or indirect, the user experiences as a result of relying wholly on this functionality of the app.

The DXone mobile application is currently available on Android and iOS. The system requirements may change without notice, and the user may need to download updates if they wish to keep using the app. DXone does not guarantee to update the mobile application to be relevant to the Android or iOS version installed on the users device. DXone may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination. Unless stated explicitly, upon any termination, (a) the rights and licenses granted to the user in these terms will end; (b) the user must stop using the app, and (if needed) delete it from your device.
